Waititu Secures Ksh.53 Million Bank Guarantee as He Seeks Release from Kamiti Prison
Through his lawyer, he confirmed that the bank guarantee has been obtained. He has been in custody since February this year
Former Kiambu Governor Ferdinand Ndung’u Waititu has notified a Nairobi court that he has secured a Ksh.53 million bank guarantee, a major requirement in his attempt to secure release from Kamiti Maximum Prison, where he is serving a sentence over a corruption-related conviction
Waititu appeared before Trial Magistrate Rose Ndobi on Tuesday for the mention of his separate hate-speech case
Through his lawyer, he confirmed that the bank guarantee has been obtained. He has been in custody since February this year
The court indicated that once the Ksh.53 million guarantee is paid, Waititu may be released, as his previous bond terms in the hate-speech case remain intact

The hate-speech case is scheduled for hearing on January 15, 2026
Waititu is accused of making inflammatory remarks on September 29, 2024, at Ruiru Stadium, Kiambu County
According to the charge sheet, the remarks targeted groups including hustlers, market vendors, boda boda riders, clergy, and teachers statements alleged to have been intended to provoke a breach of peace and threaten political figures

Prosecutors say the alleged conduct violates Section 94(1) of the Penal Code, which outlaws offensive behaviour likely to incite public disorder
They claim the former governor made the remarks publicly with the aim of creating tension among his audience
