Judge Refuses to Halt Banissa By-Election, Orders Expedited Hearing on Dual Citizenship Case

The case was filed by a voter, Mohamedin Mohammed, who seeks to nullify the candidacy of UDA’s Ahmed Maalim Hassan on grounds that the candidate allegedly holds dual citizenship

High Court Judge Lawrence Mugambi has declined to issue conservatory orders to stop the Banissa Constituency by election

Instead, the judge directed that the matter be prioritized, consolidating both the application and the main petition to be heard together without delay

The case was filed by a voter, Mohamedin Mohammed, who seeks to nullify the candidacy of UDA’s Ahmed Maalim Hassan on grounds that the candidate allegedly holds dual citizenship

Justice Mugambi ordered the respondents to file and serve their responses by tomorrow, after which the petitioner may submit a further affidavit if necessary

He emphasized that no extensions of time will be granted and any filings made outside the prescribed timelines will not be accepted by the court

The judge further directed that judgment in the matter be delivered before November 27, provided all parties comply with the court’s directions
