Court Rejects Bid to Access IFMIS Records in Sh14.8 Million Case

The High Court has declined a request by a former Nairobi Metropolitan Services employee seeking access to information contained in the government’s Integrated Financial Management Information System (IFMIS) in a case involving alleged loss of Sh14.8 million.

Justice Benjamin Musyoki dismissed the application by Jeremy Muiriria, who had sought orders compelling the Ethics and Anti-Corruption Commission (EACC) to provide detailed information relating to the IFMIS payment system and transactions at the centre of the dispute.

Muiriria wanted the court to allow him access to the system’s architecture and transaction-related information, arguing that the material was important to his case and would help explain how the disputed payments were processed.

The EACC opposed the request, maintaining that the information sought was not material in the manner claimed and that the application did not provide sufficient grounds for the court to compel production of the requested material.

The anti-corruption agency is pursuing recovery of approximately Sh14.8 million in connection with the matter.

In rejecting the application, the court found that Muiriria had not demonstrated adequate grounds for issuing an order requiring the EACC to produce the IFMIS information.

The ruling means the requested system information will not be made available to Muiriria through the application that was before the court.

The case highlights the importance of electronic government financial systems in investigations and court proceedings involving alleged misuse of public funds. IFMIS is used by government institutions to process and manage financial transactions, making its records potentially significant in disputes involving public expenditure.

The court’s decision does not by itself determine the underlying allegations concerning the Sh14.8 million. The substantive issues surrounding the disputed funds remain subject to the ongoing legal proceedings.

Muiriria will therefore have to proceed with the case without obtaining the IFMIS material through the application dismissed by Justice Musyoki.
