Court Orders Blogger to Apologize to MP Nabwera Over Defamatory Murder Allegations
The interim order, issued pending the full hearing of the defamation case, followed an application by MP Nabwera through his lawyer, Danstan Omari
The Milimani Chief Magistrates Court has directed Kakamega-based blogger Simon Asiviela to issue a public apology to Lugari MP Nabii Daraja Nabwera for publishing false and defamatory claims linking the legislator to the death of Munyuki High School Principal Simon Isiaho Shange
The interim order, issued pending the full hearing of the defamation case, followed an application by MP Nabwera through his lawyer, Danstan Omari

According to court filings, Asiviela’s posts shared on online platforms including Kakamega Post, Malava Online, and Lugari Watchdog falsely accused the MP of involvement in the principal’s disappearance and death. Nabwera described the posts as “malicious, politically motivated, and baseless”
In his affidavit, the MP stated that the posts incited public anger, with some individuals threatening to invade and vandalize his home in Lugari, thereby endangering his family and damaging his reputation

Nabwera sought urgent conservatory orders to stop further defamatory publications and demanded Ksh. 20 million in damages for reputational harm. The court certified the matter as urgent and ordered Asiviela to publicly retract the false statements and apologize to the MP
The apology must be made on the same platforms where the defamatory posts were published
