Josphat Gichunge Kabeabea, Chairperson of the Anti-Counterfeit Authority (ACA) Board of Directors, has appeared in a Nairobi court facing four counts of receiving bribes, contrary to Section 6(1)(a) read with Section 18 of the Anti-Bribery Act No. 47 of 2023
Kabeabea is accused of demanding and receiving money from Chinese national Du Zhisheng on November 11, 2025, to halt enforcement actions against him for allegedly dealing in counterfeit motor vehicle spare parts

According to the charge sheet:
He allegedly sought Ksh. 5 million to prevent the complainant’s arrest and prosecution
The second count involves a demand of Ksh. 1 million
The third count alleges he requested an additional Ksh. 300,000
The fourth count states he received Ksh. 144,500 via a mobile number registered to Ntorui Erastus Kaibi
Kabeabea denied all charges

During the bail hearing, the prosecution did not oppose bail but requested conditions to prevent interference with witnesses, public comments, and to have the accused deposit his passport in court
Defence counsel Okatch opposed enhanced bail, arguing it should not be pegged to the alleged bribe amounts
The magistrate approved bail of Ksh. 2 million bond (or Ksh. 1 million cash), with conditions that Kabeabea deposit his passport and refrain from interfering with witnesses or commenting publicly on the case
The prosecution must supply witness statements within 14 days
