Private Clinic Owner Faces Charges Over Ksh.2.5 Million SHA Fraud in Kakamega

Josephat Ouma Omoto, who owns Zion Ahadi Mediclinic Limited, faces charges of falsifying health documents, contrary to Section 48(3) of the Social Health Insurance Act

The proprietor of a private medical facility in Kakamega County has been arraigned at Milimani Law Courts over multiple charges involving alleged falsification of health records and laundering of funds obtained from the Social Health Authority (SHA)

Josephat Ouma Omoto, who owns Zion Ahadi Mediclinic Limited, faces charges of falsifying health documents, contrary to Section 48(3) of the Social Health Insurance Act

Prosecutors claim that between January 1 and June 30, 2025, Omoto fraudulently inserted patient details to misrepresent that they had consented to or received treatment, with the intent to defraud SHA and unlawfully obtain benefits

In addition, Omoto and his clinic are charged with acquiring proceeds of crime, contrary to Section 4(a) read with Section 16(1) of the Proceeds of Crime and Anti-Money Laundering Act (POCAMLA)

Prosecutors allege he obtained Ksh.2,591,125 from SHA via a Cooperative Bank account, knowing the funds were proceeds of crime

Omoto is also accused of using the proceeds illegally, in violation of Section 4(b) read with Section 16(1) of POCAMLA

Further, he faces three counts of uttering false documents under Section 353 of the Penal Code, allegedly submitting fraudulent inpatient discharge summaries to SHA for claim processing

The alleged offences involve discharge summaries for Florence Rachael Atero (Claim No. 4745787), Elida Munyokho Omukoyia (Claim No. 2262927), and Milka Omwaka Winnie (Claim No. 1506677), submitted between January and March 2025 at Zion Ahadi Mediclinic Limited

Omoto, described in court as a father of three and a diabetic, was presented before the court as police sought custodial orders

The court has directed that a pre-bail report be prepared for review on Monday, pending further instructions on bond and bail

The matter will return to court once the pre-bail report is filed
