Kitui Assistant Chief Charged Over Irregular Issuance of Burial Permit

An assistant chief in Tseikuru Sub-County, Kitui County, has been arrested and charged for allegedly issuing a burial permit without the legally required documentation
Mwathiki Musili, the assistant chief of Kamuthanga Sub-Location, is accused of neglecting official duty after authorising a burial without first obtaining a medical certificate to confirm the cause of death, as mandated by law
According to the Directorate of Criminal Investigations (DCI), Musili was arrested by detectives in Tseikuru Sub-County and briefly detained before his case file was forwarded to the Office of the Director of Public Prosecutions (ODPP)

“Upon review, the ODPP concurred with the investigating officer’s recommendation to charge Musili with Neglect of Official Duty, contrary to Section 128 as read with Section 36 of the Penal Code,” the DCI said in a statement
The agency described the alleged offence as a serious breach of established procedures meant to safeguard public health and ensure compliance with legal standards surrounding death registration and burial
Musili appeared before the Kyuso Law Court, where he pleaded not guilty to the charge. The court granted him bail of Ksh.70,000
The case is scheduled for mention on January 7, 2026
