Court Blocks Attempt to Obtain Search Warrants Against Tuju

Investigators had moved to court under provisions of the Criminal Procedure Code seeking authority to search and seize materials believed to be linked to an alleged false report case. However, the magistrate ruled that the evidence presented failed to demonstrate reasonable suspicion that Tuju had committed the offence cited in the application.

The ruling was delivered at the Milimani Magistrate’s Court, where the magistrate found that the request by investigators lacked sufficient grounds to justify issuing the warrants. According to the court, the application did not clearly establish an offence that would require the search of Tuju’s home.

Investigators had moved to court under provisions of the Criminal Procedure Code seeking authority to search and seize materials believed to be linked to an alleged false report case. However, the magistrate ruled that the evidence presented failed to demonstrate reasonable suspicion that Tuju had committed the offence cited in the application.

The court also noted that the report referenced in the investigation had initially been recorded by another individual, and details linking Tuju directly to the alleged offence were not adequately presented.

“As it stands, the application does not disclose an offence to be investigated on the part of the respondent,” the court ruled, adding that granting the request would not serve the interests of justice.

Tuju’s legal team opposed the application, arguing that the move by investigators was an abuse of the court process and lacked proper justification. The defence further told the court that there was already a related matter pending before another court, making the new request unnecessary.

The ruling is the latest development in a series of legal battles involving the former minister, who has recently been in the spotlight over investigations linked to allegations of giving false information to authorities.
