In a statement issued on Wednesday, the DCI said the suspect was apprehended during an operation conducted by officers from the Operations Support Unit (OSU) in the Shujaa Mall area of Kayole, Nairobi.
According to the agency, the 33-year-old is under investigation for what it described as viral public utterances that could incite violence, spread hatred, and threaten public order and national cohesion.
The DCI added that the suspect is currently in custody undergoing processing ahead of arraignment in court. However, it did not provide details of the specific remarks or posts that led to the arrest.
“The DCI cautions the public against making public utterances or disseminating content that incites violence, spreads hatred, or undermines peace and national unity,” the agency said, warning that individuals found culpable will face legal action.
The arrest has sparked political reactions online, coming a day after Siaya Governor James Orengo publicly claimed that Kawala had been abducted by state agents.
In a post on X, Orengo alleged that the activist—who is associated with the Jacaranda Bunge la Mwananchi civic movement—had been taken for “speaking truth to power,” and called for his immediate and unconditional release.
The claims triggered debate among supporters and critics, with questions raised over the circumstances surrounding the arrest and concerns about freedom of expression.
Kawala is known for his participation in grassroots civic forums and outspoken commentary on governance and political accountability, often attracting both support and criticism on social media platforms.
However, the DCI maintained that the arrest is strictly tied to alleged violations of laws governing public communication and incitement.
