IEBC Cracks Down on Polling Violations Ahead of By-Elections

The Independent Electoral and Boundaries Commission (IEBC) has warned of strict consequences for individuals who violate election laws during the ongoing by-elections, stressing its commitment to ensuring a peaceful, transparent and credible voting process.

In a statement issued ahead of the polls, the electoral body cautioned voters, political parties, candidates and election officials against engaging in activities that could compromise the integrity of the elections. IEBC emphasized that all participants must observe electoral regulations to guarantee free and fair voting.

Among the major concerns raised by the commission is the growing tendency of some voters to take photographs or record videos inside polling booths. IEBC reiterated that taking images of marked ballot papers is prohibited and constitutes an election offence under Kenyan law.

The commission warned that offenders risk severe punishment, including fines of up to KSh1 million, imprisonment for a period not exceeding three years, or both. According to IEBC, the restriction exists to protect the secrecy of the ballot and shield voters from coercion, bribery or political intimidation.

At the same time, the commission reminded political actors and their supporters to maintain discipline around polling centres and avoid actions that may disrupt the voting exercise. IEBC noted that only accredited individuals, including authorized party agents and election officials, will be allowed access to polling and tallying centres.

The electoral body also advised voters against wearing clothing, badges or other materials displaying political party symbols while inside polling stations, saying polling centres must remain neutral environments free from political influence.

Additionally, Kenyans were urged to cast their votes peacefully and leave polling stations immediately after voting to allow smooth operations and reduce congestion. Election officials have also been instructed to remain professional and impartial throughout the exercise.

IEBC further warned that any election officer found violating the code of conduct or engaging in misconduct would face disciplinary action in accordance with the law.

As by-elections continue in different parts of the country, the commission has appealed to Kenyans to cooperate with authorities and uphold peace to ensure the process reflects the democratic will of voters.

The commission maintained that safeguarding public confidence in elections remains a top priority, adding that strict enforcement of electoral laws will be key to preventing malpractice and maintaining order throughout the voting period.
