Senate Blocks Impeachment Bid Against Nyamira Governor Amos Nyaribo

The Senate on Wednesday halted the impeachment proceedings against Nyamira Governor Amos Nyaribo after upholding two key preliminary objections raised by his defence team
In a decisive vote, 38 Senators supported stopping the process while only four voted against it, effectively ending the bid before it could advance to a full hearing
Governor Nyaribo’s lawyers had argued that the impeachment motion, dated November 11, 2025, failed to meet constitutional thresholds under Article 181 of the Constitution and Section 33 of the County Governments Act .They termed the County Assembly’s resolution “invalid and incompetent”

The defence also challenged the use of proxy voting during the Assembly’s impeachment vote. Lead counsel Elias Mutuma dismissed the practice as illegal, saying it had been invoked to mask discrepancies in vote tallies
According to the lawyers, only 19 MCAs were physically present, yet 23 votes were recorded in favour of impeachment a result they described as “numerically impossible”
They further disputed the Assembly’s claim that its membership had reduced from 35 to 32 due to three vacancies, calling the explanation illogical and unsupported by law

County Assembly representatives defended the process, arguing that proxy voting was permissible under Standing Order No. 1 and that proxy letters existed to justify the votes
Senators, while debating the objections, underscored the need to uphold fairness for the Governor, the Assembly and the residents of Nyamira
The Senate ultimately ruled in favour of the objections, bringing the impeachment proceedings to an abrupt end
