Court Denies Blogger Ndiang’ui Kinyagia’s Request to Retrieve Passport for Medical Travel

They argued that releasing them could compromise the case, noting that the Director of Public Prosecutions (DPP) is considering charges against him

A Nairobi court has declined to release the passport of IT expert and social media commentator Ndiang’ui Kinyagia, who is under investigation for undisclosed offences

Prosecutors told the court that Kinyagia’s travel documents, including his passport and yellow fever card, were part of ongoing investigations

They argued that releasing them could compromise the case, noting that the Director of Public Prosecutions (DPP) is considering charges against him

“I am inclined to object to the release of the documents as it will compromise the ongoing probe,” a state counsel told the court

Kinyagia’s lawyer had appealed for the passport’s release, saying his client needed to travel to India urgently to accompany his sister for medical treatment. “Health does not wait; this travel is an emergency,” the lawyer pleaded

However, the court declined to issue interim orders and instead directed Kinyagia to file written submissions. A ruling on the matter will be delivered on January 15, 2026

In a separate case, the court allowed the release of the passport belonging to Dan Achola Okoth, son of former Migori Governor Okoth Obado, to facilitate a business trip abroad

His lawyer was instructed to present proof of travel plans and board membership before departure

That case, involving Ksh.505 million fraud charges, will be mentioned on December 8, 2025, for compliance and further directions
