High Court Orders Former Kiambu Governor Waititu to Forfeit Ksh.76.2 Million in Assets

The High Court has ordered the government to seize assets valued at Ksh.76.2 million allegedly owned by former Kiambu County Governor Ferdinand Waititu

In addition, the court directed that two plots of land worth Ksh.32 million, along with one plot owned by his wife, Susan Ndung’u, be returned to the government. The ruling followed findings that Waititu and his wife failed to adequately explain the source of the assets

Waititu and his wife had opposed the case, claiming the assets were legally acquired through business proceeds and loans before his tenure as governor

Among the seized assets are a Caterpillar machine valued at Ksh.11 million and two vehicles worth Ksh.600,000 each

Justice Nixon Sifuna partially allowed a civil case filed by the Ethics and Anti-Corruption Commission (EACC), which had sought the recovery of Ksh.1.9 billion in allegedly illicitly acquired assets

The court, however, rejected the confiscation of funds held in various bank accounts linked to Waititu, his wife, and their companies, citing insufficient evidence

The ex-governor was previously found guilty in February 2025 of conflict of interest in a Ksh.588 million graft case

He was sentenced to 12 years in prison or a Ksh.52.5 million fine. His wife received a one-year prison term or a Ksh.500,000 fine
